Pocso Act Court Sentences Accused To 20 Years Imprisonment For Physically Exploiting Minor | Kanpur News

KANPUR: Special Judge POCSO Act court Vikas Gupta on Saturday sentenced accused Akash Kumar alias Golu to 20 years with a fine of Rs 50,000 for physical exploitation of a minor girl. The court directed that fifty percent of the fine (Rs 25,000) be given to the victim for her medical expenses and rehabilitation. The court however acquitted the accused from the charges of enticing and abduction.
According to ADGC, Ganga Prasad Yadav and special prosecutor Chandra Kant Sharma, the victim’s father, a resident of Govind Nagar area, had lodged the report on August 24, 2019 and stated therein that on August 23, 2019, his minor daughter had gone to Barra market to buy some goods but did not return.
The victim in her statement recorded under section 161 and 164 of Cr PC stated that she has been knowing accused Akash since for the last three years and had an affair. On August 23, 2019, she without informing anyone in the home had left for Delhi where Akash was employed and stayed there for around 15 days. Though she had not married him, yet they have physical relations.
The defence argued that the girl in her statement stated that she had gone to Delhi on her own will and stayed with Akash. Akash was innocent in this case therefore he should be acquitted, the defence counsel pleaded. The prosecution argued that the girl was a minor at the time of the incident, therefore, her consent for physical relationship had no meaning. As per the provisions of the Act, the accused had committed an offence after knowing that she was a minor.
