Kanpur: Additional sessions judge-XVI Jitendra Kumar Dwivedi on Monday rejected the bail applications of accused Shariq Ahmed of Khapra Mohal, Mohd Sartaj, a resident of Colonelganj and Faizal Jafrey of Chamanganj who had been charged by the police under sections 47/148/149/307/323/332/333/336/353/427/504/506/120-B IPC and section 7 of the Criminal Law (Amendment) Act and section 3/4 of Prevention of Damage to Public Property Act, 1984 for being involved inn Parade and Nai Sadak violence.
Accused Shariq and Mohd Sartaj had preferred their bail applications in all the three cases while Faizal moved his bail application in two cases. Thus, in all, eight bail applications were rejected by the court.
According to ADGC, Dinesh Kumar Agarwal, the defence lawyers argued that the prosecution had not presented CCTV footage before the court. The court observed in its order that an FIR against the accused was lodged and his name appeared during the investigation in the CCTV footage. The police charged that he and others had assembled with an intention to attack police force and the public and kill them. They hurled petrol bombs, opened fire and created chaos among the public on June 3 during the Nai Sarak violence.
According to special prosecutor Pankaj Tripathi, accused Shariq had also played a key role during the violence while Sartaj and Faizal were identified in the CCTV footage. As they had played the role of carrier in disbursement of money, therefore, their bail applications should be rejected.
