Kanpur: Additional sessions judge-XVI Jitendra Kumar Dwivedi on Thursday adjourned the hearing of the anticipatory bail application of accused Mahmood Umar and Mohd Hamza, manager of the accused builder Mohd Wasi who had been charged by the police under sections 147/148/149/307/323/332/333/336/353/427/504/506/120-B of IPC and section 7 of the Criminal Law (Amendment) Act and section 3/4 of the Prevention of Damage to Public Property Act,1984.
The court also rejected the regular bail applications of Siraj Husain, Faizul Haq and Mohd Faisal who were wanted in three criminal cases–Case Crime No. 42, 43 and 44 of 2022. Siraj and Faisal had preferred bail applications in all the three cases while Faizul Haq in one case. The court observed in its order that during the investigation the accused was identified in the CCTV footage. The police had charged him and the others for having assembled with an intention to attack police force and the public and kill them as they hurled petrol bombs, opened fire and created chaos among the public on June 3 during the Nai Sadak violence. According to ADGC Dinesh Agarwal, Siraj was originally a resident of Ambedkar Nagar but nowadays was living in Shukla Ganj. He was identified in the CCTV footage. Besides inciting the people to come on road he had played a role in engaging criminals in the attacks.
Special public prosecutor Pankaj Tripathi argued that since accused Mohd Faisal and Faizul Haq had been identified in the CCTV footage, therefore, their bail applications should be rejected.
